Second Chance Cleveland Browns Contest sponsored by the Ohio Lottery
The Second Chance Ohio Lottery Promotion (hereafter, “Contest”) is open only to legal residents of Ohio who are eighteen (18) years of age or older aas of the date of entry. Employees, officers, directors, agents and representatives of the Ohio Lottery Commission (“Sponsor”), the Browns (defined below), the National Football League, its member professional football clubs, NFL Ventures, Inc. and each of their respective parents, affiliates, subsidiaries, wholesalers, retailers, distributors, suppliers, advertising and promotion agencies (hereafter, collectively, “Released Parties”), and each such individual’s immediate family members (mother, father, sister, brother, any child, husband, wife and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related, are not eligible to participate or win a prize. Void where prohibited by law. All applicable federal, state and local laws apply. The information provided by entrants will only be used for Contest purposes. For purposes of these Official Rules, the “Browns” shall be defined to include the Cleveland Browns Football Company LLC, Cleveland Browns Stadium Company LLC, Cleveland Browns Transportation LLC, Cleveland Browns Holdings LLC.
2. PROMOTION PERIOD:
The Contest begins at 5:00:00 pm Eastern Time (“ET”) on 9/5/12 and ends 11:59:59 pm ET on 12/1/12 (hereafter, “Promotion Period”).
3. HOW TO PARTICIPATE:
There are two (2) ways to participate: (1) send a non-winning five dollar ($5.00) 20X The Money Ohio Lottery ticket with your name, address, daytime phone number, and date of birth printed neatly on the back, to Cleveland Browns Stadium, Attn: Ohio Lottery/Second Chance to Win, 100 Alfred Lerner Way, Cleveland, OH 44114; or (2) send a 3’ x 5’ card with your name, address, daytime phone number, e-mail address and date of birth printed neatly (each an “Entry”) to Cleveland Browns Stadium, Attn: Ohio Lottery/Second Chance to Win, 100 Alfred Lerner Way, Cleveland, OH 44114. All Entries must be mailed in a business envelope. You may enter as often as you like, however to be eligible, each non-winning Ohio Lottery ticket must be unique. No mechanically reproduced or photocopied entries permitted. Illegible entries are void. Multiple entries mailed in one envelope will not be accepted.
Incomplete Entries and/or Entries containing inaccurate entrant information will be disqualified at Browns’ sole discretion. All Entries must be received by the end of the Promotion Period to be considered. The use of script, macro or any other device to automate or subvert the entry process is prohibited and all such Entries and Entries made by any other means which subvert the entry process will be void. Other than as otherwise specified herein, none of the Sponsor, the Browns, or agents thereof, will enter into any communications with any entrant regarding this Contest (except for the purposes of notifying the winners) or acknowledge any Entry (or portion thereof) received. Any Entry not meeting all Entry requirements stated herein will be void.
4. PRIZE DRAWING:
The potential Grand, First and Second Prize winners will be selected in a random drawing conducted on or about 12/4/12 from among all eligible Entries. In the event there are no eligible Entries received, no prize will be awarded. Sponsor reserves the right to not award all prizes if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Entries (under ten (10). Three (3) alternates will be chosen in each random drawing for all prize levels awarded. All winners selected must accept their prizes within three (3) days of notification or an alternate will be selected in the order drawn.
By entering, entrants agree to be bound by these Official Rules and to the decisions of the Sponsor and the Browns, which will be final and binding in all respects. The potential Grand, First and Second Prize winners will be notified by telephone and/or email and/or mail and/or overnight mail on or about 12/4/12.
5. WINNER NOTIFICATION:
Grand, First and Second Prize winners will be required to execute and return an Affidavit of Eligibility, Liability and (where legal) Publicity Release within three (3) days of date of issuance of notification. Non-compliance with the foregoing, with these Official Rules, the inability to contact a potential winner (as specified above) within three (3) days of the drawing, or return of prize or prize notification as non-deliverable may result in disqualification and, at Sponsor’s discretion and time permitting, awarding of prize to an alternate. Odds of winning depend on the number of eligible Entries received.
(8) Grand Prizes: One pair of Luxury Suite tickets to the Cleveland Browns vs. Washington Redskins game on 12/16/12 (including standard food and non-alcoholic beverage package), Cleveland Browns merchandise valued at $50 and an Ohio Lottery prize pack valued at $50. Exact merchandise and size, if applicable, will be determined by the Browns in its sole discretion. Merchandise is not game worn. ARV = $245.
(50) First Prizes: One pair of tickets to the Cleveland Browns vs. Washington Redskins game on 12/16/12 and an Ohio Lottery prize pack valued at $10. Exact merchandise and size, if applicable, will be determined by the Browns in its sole discretion. Merchandise is not game worn. ARV = $175.
(25) Second Prizes: Cleveland Browns merchandise valued at $50 and an Ohio Lottery prize pack valued at $10. Exact merchandise and size, if applicable, will be determined by the Browns in its sole discretion. Merchandise is not game worn. Approximate Retail Value (“ARV”) = $60 each.
For Grand and First Prizes: Transportation to and from the game is the sole responsibility of the winners. Exact seat location determined by the Browns in its sole discretion. In the event the winner resides outside a two-hundred (200) mile radius of Cleveland Browns Stadium, Grand Prize winner will receive a prize of equal or greater value in lieu of the above listed Grand prize and the First Prize winner will receive a prize of equal or greater value in lieu of the above listed First prize. The tickets are subject to the terms and conditions specified thereon. Unused tickets cannot be refunded, exchanged or applied towards tickets for other events or games. Winner and guest must comply with all venue rules and regulations. Failure to do so may result in forfeiture of such portion of the prize and removal from the game. Browns reserve the right to remove or to deny attendance to any winner and/or guest who engages in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the game.
Costs and expenses associated with the acceptance and use of a prize not specified herein as being awarded, including, but not limited to, all federal, state and local taxes, transportation to/from the stadium (if applicable, food, beverages, souvenirs, gratuities, etc.) are winner’s sole responsibility. Prize is awarded “as is” with no warranty or guarantee, either express or implied by Sponsor or the Browns. All prize details are subject to the discretion of the Sponsor and the Browns.
No transfer, assignment, cash redemption, or substitution of prize (or portion thereof) except by Sponsor or Browns who reserves the right to substitute a prize (or applicable portion thereof) with one of comparable or greater value, as determined by Sponsor. Entrants agree, by entering, that 1) Sponsor, the Browns and each of its designees may use (unless prohibited by law), except as otherwise provided herein, entrant’s name, city and state of residence, Entry, photograph, any recording or written content, and/or likeness for advertising, trade and/or any other purposes in any media, including, but not limited to, online at Sponsor and Browns website and/or social media pages, now or hereafter known throughout the world in perpetuity, without further compensation, permission or notification, and 2) the Released Parties shall have no liability and will be held harmless by entrant for any claim, action, liability, loss, injury or damage to entrant or any other person or entity, including, without limitation, personal injury or death to entrant or any other person or damage to personal or real property, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of any prize and any travel or travel-related activity thereto (including, but not limited to, attendance at any game), participation in this Contest or the use of any Entries by Sponsor, the Browns, or either of its designees or any third party. Sponsor and the Browns reserve the right, in its sole discretion, to modify, terminate or suspend this Contest (or any portion thereof) should virus, bugs, non-authorized human intervention or other causes corrupt or impair the administration, security, fairness or proper play of the Contest (or any portion thereof) and, in the event of termination, at its discretion, select the winners from those eligible, non-suspect Entries received prior to event requiring such termination using the applicable judging/winner selection procedure outlined herein.
8. ASSIGNMENT OF RIGHTS:
Entrants warrant and represent that (1) Sponsor and the Browns shall own the Entry (and all material and rights embodied therein) and that such Entry will not be acknowledged or returned; and (2) that by entering, the Entrant irrevocably assigns to Sponsor, the Browns and each of its designees any and all rights, title and interest in the Entry. Entrants further agree to abide by these Official Rules and the decisions of the Sponsor, the Browns, and judges, which shall be final and binding. Entrant's submission of an Entry constitutes his/her representation of eligibility, consent to participate in Contest and consent for Sponsor and the Browns to obtain, use and/or post entrant’s name and photograph online at ClevelandBrowns.com and OhioLottery.com.
Released Parties are not responsible for lost, incomplete, invalid, unintelligible, inaccurate, undeliverable, garbled, late, illegible, stolen, damaged or misdirected Entries, all of which will be disqualified; failures or malfunctions of phones, phone lines or telephone systems or other communications or malfunctions; interrupted or unavailable network, server, cable, satellite, Internet Service Provider (ISP) or other connections; miscommunications, failed computer hardware or software or other technical failures; garbled, lost, misrouted or scrambled transmissions; any error, omission, interruption, defect or delay in any transmission or communication; traffic congestion on the Internet or for any technical problem; theft, destruction or unauthorized access to, or alteration of, Entries; or human-processing error; printing, typographical or other errors or omissions in these Official Rules or in any Contest-related advertisements or other materials; or other errors or problems of any kind whether mechanical, human, technical, network, electronic; or errors which may occur in connection with the administration of the Contest, the incorrect uploading or submitting of Entries, the processing of Entries, the cancellation or postponement of any game, the awarding or announcement of winners, or in any other Contest-related materials. Sponsor and the Browns reserve the right to void and remove any and all Entries of an entrant who Sponsor or the Browns believe has attempted to tamper with, influence, or impair the administration, security, fairness, judging or proper play of Contest and such entrant will be disqualified and all associated Entries will be void. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR AND THE BROWNS RESERVE THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
