ELIGIBILITY: The Ohio Lottery InspiredOH Promotion (the “Promotion”) is open only to individuals who are legal residents of Ohio, and are 18 years of age or older. Entries that are incomplete or that contain errors, trademarks/logos, copyrighted images or inappropriate/derogatory/defamatory images, language, nudity or profanity will be automatically disqualified.

You acknowledge that all approved entries may exist in perpetuity on inspiredoh.org. Additionally, by entering, you grant the Ohio Lottery the perpetual and irrevocable right to use your story in its marketing efforts. By participating, you also agree to execute any and all documents reasonably required by Sponsor regarding the truthfulness and/or accuracy of a submitted entry.

Eligible participants who submit an approved entry will receive a free InspiredOH shirt. A shirt in the requested size will be mailed to the address provided by each participant within approximately six weeks of submission. Shipping costs will be covered by the Sponsor. No returns or exchanges will be accepted. Limit of one (1) shirt per eligible participant.

PROMOTIONAL TIMING:
Timing for the Giveaway is outlined below (the “Entry Period”). Entries received outside of the Entry Period or that do not adhere to the promotion terms and conditions (“Terms and Conditions”) will be disqualified.

May-June Entry Period: May 1, 2020 at 12 p.m. ET to June 30, 2020 at 11:59 p.m. ET

MAY-JUNE DRAWING TERMS AND CONDITIONS:

Marcus Thomas LLC, a contracted partner of the Ohio Lottery, will conduct the InspiredOH Theme Promotion (“Giveaways”) during the months of May and June 2020.
To be eligible for a prize, entrants must be residents of Ohio and eighteen (18) years of age or older; however, all legal residents of the 50 United States, and the District of Columbia, who are 18 years of age or older are encouraged to share their Ohio-centric stories.
Employees and Directors of the Ohio Lottery Commission and their related companies, as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee and director are not eligible for this promotion.
During the promotional period, qualified/theme appropriate approved submissions will be awarded prizing as determined by the discretion of the Sponsor. Submission will be judged on the following criteria:

Production quality (10%)
Engaging storytelling (20%)
Capturing the brand’s values (20%)
Originality and uniqueness (20%)
Expert opinion (30%)

Entrant’s chances of winning will depend on the above criteria as well as the number of entries. Each submission will be scored on a 5-point scale using .5 increments. Should at least one story score above an aggregate score of 4.5, the top score will win the prize. Should multiple submissions tie for the top score, a random number generation will be used to select the prize winner. Those entries will be sequentially number 1-X and will be listed in date order. The entry matching the number drawn will be deemed the winner. If no story scores a 4.5 or higher, all stories scoring between 3.0 and 4.49 will be entered into a random drawing to be conducted as previously outlined. If no story scores 3.0 or higher, the highest scoring story will be selected.

The winner will be contacted by the official InspiredOH administrative email address to coordinate prize acceptance/fulfillment. The correct email is admin@inspiredoh.org. Please provide your information to this email and none others. If for any reason the winner does not accept the prize, the same process will be repeated until a winner is declared.

The Sponsor will contact the winner by the email address included in their submission in 5-10 business days following the close of the submission period. If a potential winner does not reply to the email within 48 hours, the potential winner will be deemed to be ineligible and disqualified.

Winners will initially be contacted via email. Upon receipt of the acceptable documentation, Marcus Thomas LLC will issue the prize on behalf of the Ohio Lottery.
By participating in the Giveaway, the entrant assumes all liability for any personal injury or damages caused or claimed to be caused by, arising out of, or in connection with his or her participation in the Giveaway and/or the acceptance and/or use of any prize, and hereby indemnifies, holds harmless and releases the Lottery and Marcus Thomas LLC and their employees and agents from any and all such liability. Neither the Ohio Lottery or Marcus Thomas LLC and their employees or agents is responsible for technical, hardware, software, or telephone malfunctions of any kind; lost or unavailable network connections; or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user or by any of the equipment or programming associated with or utilized in this Giveaway.
If, for any reason, the Giveaway is not capable of running as planned, including infection by computer virus, bugs, tampering, and unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Ohio Lottery that, in the sole judgment of the Ohio Lottery, could corrupt or affect the administration, security, fairness, integrity of the giveaway, the Lottery reserves the right in its sole discretion to cancel, terminate, modify or suspend the Giveaway.
Governing Law: All applicable federal, state and local laws and rules apply. The Giveaway and these Terms and Conditions will be governed by the laws of the State of Ohio. Any court of competent jurisdiction sitting within the State of Ohio, County of Cuyahoga, will be the exclusive jurisdiction and venue for any dispute arising out of or relating to the Giveaway or these Terms and Conditions. The Ohio Lottery's failure to enforce any term of these Terms and Conditions shall not constitute a waiver of that provision.
Taxes and Expenses: Winners are responsible for any local, state and federal taxes. Any additional expenses incident to any prize (including, without limitation, any related travel) are the responsibility of each respective winner.
By entering the Giveaway, a player gives his or her permission for the Ohio Lottery to use the player’s social handle, name, city, state, likeness and/or voice for the purposes of advertising, promotion and publicity without additional compensation.
Prizes are nontransferable.
The winner will be added within four weeks of him/her formally accepting his/her prize at [LINK TO LANDING PAGE FOR WINNERS WITHIN THE MICROSITE].
Eligible winners must will be required to complete and return an affidavit of eligibility and liability/publicity release (the “Affidavit/Release”) within forty-eight (48) hours of being notified.

PUBLICITY: All information submitted to Sponsor as part of this Promotion will be treated in accordance with the Ohio Lottery Privacy Policy (https://www.ohiolottery.com/About/Legal/Privacy-Policy). By entering this promotion, you authorize Sponsor to utilize your entry, name and likeness as part of promoting the Ohio Lottery.

During each of the entry period, the winner will receive a $100 Visa gift card.

GENERAL CONDITIONS: By participating, you acknowledge that Sponsor reserves the right to cancel this promotion or modify these Terms and Conditions from time to time as Sponsor deems appropriate. In the event that any fraud, virus, technical error, bug, unauthorized human intervention or other problem impairs the administration, fairness, integrity or security of the Promotion, Sponsor may, in its sole discretion, suspend or cancel the Promotion. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the operation of the Promotion, or to be acting in violation of these Official Terms and Conditions or in a disruptive manner. Any attempt by any person to undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any provision of these Official Terms and Conditions shall not constitute a waiver of that provision.

By participating, you acknowledge that Sponsor has the right to edit any entry to correct grammatical, typographical errors, and misspellings.

Sponsor reserves the right to substitute prizes as it may deem necessary. Substituted prizes shall be of equal value.

RELEASE AND LIMITATIONS OF LIABILITY: By participating in the Promotion, entrants agree to release and hold harmless Sponsor, its officers, directors, employees and agents (the “Released Parties”) from and against any loss, claim, cause of action or liability arising out of participation in the Promotion, including, but not limited to: (a) unauthorized human intervention in the Promotion; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing or human errors; (d) errors in the administration of the Promotion or the processing of entries; (e) any incorrect or inaccurate entry information; (f) inability to access the Sponsor’s website or Twitter; (g) transactions that are processed late or incorrectly, or are incomplete or lost due to computer or electronic malfunction, or traffic congestion on the internet or at any website; or (h) injury or damage to persons or property, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Promotion.

DISPUTES: Except where prohibited, entrant agrees that: (a) any and all disputes, claims and causes of action arising out of, or connected with, the Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Ohio; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering a Promotion, but in no event attorneys’ fees or expenses; and (c) entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct or indirect damages. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Terms and Conditions, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Promotion shall be governed by, and construed in accordance with, the laws of the State of Ohio, without giving effect to any choice of law or conflict of law rules (whether of the State of Ohio or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Ohio.
