NOTICE OF PUBLIC HEARING
OHIO LOTTERY COMMISSION HEARING ON
THE ADOPTION OF NEW AND AMENDED ADMINISTRATIVE RULES
 
Notice is hereby given that the Ohio Lottery Commission intends to adopt eight new administrative rules in Proposed Form and one amended administrative rule in Proposed Form. A public hearing will be conducted on Tuesday, September 13, 2022, at the Frank J. Lausche Building, 615 West Superior Avenue, 4th floor, Cleveland, Ohio 44113, at 10:00 A.M. in accordance with the Administrative Procedures Act, (Chapter 119, Ohio Revised Code). Any person affected by the proposed action may appear and be heard in person, by the person’s attorney, or both; may present the person’s position, arguments, or contentions, orally or in writing; offer and examine witnesses; and present evidence tending to show that the proposed rule, amendment, or revision, if adopted or effectuated, will be unreasonable or unlawful.

The new rules to be considered for adoption are Ohio Lottery Administrative Rules 3770:3-3-03, 3770:3-5-03, 3770:3-6-01, 3770:3-6-03, 3770:3-6-04, 3770:3-6-05, 3770:3-8-01, and 3770:3-8-03. These new rules relate to type C sports gaming host rules, type C sports gaming host eligibility and application for Lottery recommendation, house rules, sports gaming systems, Lottery sports gaming equipment approval and testing, type C sports gaming proprietor equipment for hosts, incident reporting, revenue and compensation, and accounting and revenue.

The amended rule to be considered for adoption is Ohio Lottery Administrative Rule 3770:2-8-04. This amended rule relates to the responsibilities of excluded facilities and excluded entities under the jurisdiction of the Ohio Lottery Commission.
