NOTICE OF PUBLIC HEARING

OHIO LOTTERY COMMISSION HEARING ON THE RESCISSION OF ONE ADMINISTRATIVE RULE

Notice is hereby given that the Ohio Lottery Commission intends to rescind one (1) Administrative Rule.  A public hearing will be conducted on March 18, 2014 at the Frank J. Lausche Building, 615 West Superior Avenue, 4th floor, Cleveland, Ohio 44113, at 10:00 A.M. in accordance with the Administrative Procedures Act, (Chapter 119, Ohio Revised Code).  Any person affected by the proposed action may appear and be heard in person, by the person’s attorney, or both; may present the person’s position, arguments, or contentions, orally or in writing; offer and examine witnesses; and present evidence tending to show that the proposed rule, amendment or revision, if adopted or effectuated, will be unreasonable or unlawful.

The Rule to be considered for rescission is Ohio Lottery Administrative Rule 3770-4-01, a rule which is no longer relevant. (See Rule 3770-4-01 posted below.)

The purpose of the rescission is to eliminate unnecessary rules.

3770-4-01     Scope of regulations: director may provide management instructions.
The procedures set out in this chapter shall provide the substantive operating standards for all sales agents. The director may establish, through management regulations, instructions or directives, the detailed operating procedures by which the purposes of this chapter, these regulations, the commission's rules and the Lottery Act will be implemented.
